If an Associate provides less than 8 weeks' written notice, the Company can postpone their return to such a date as will ensure proper notice has been given.

If an Associate returns to work before they have exhausted their entitlement to shared parental pay and/or shared parental leave, their husband, partner or civil partner may be entitled to take shared parental leave and receive shared parental pay from his/her employer. He/she should contact his/her employer for details on eligibility.

If an Associate returns to work early, their entitlement to shared parental pay will cease with effect from the date on which their shared parental leave ceases.

Deciding not to return

If an Associate does not intend to return to work following shared parental leave, or they are unsure, it would be helpful if they could discuss this with their Manager or the Human Resources Division as early as possible. If an Associate decides not to return, they are required to give the Company the appropriate notice to terminate their employment as specified in their contract of employment.

If an Associate decides not to return to work after a period shared parental leave, this does not affect their right to receive shared parental pay.

If an Associate has any questions about this section or about any other aspect of their shared parental leave rights, they should contact the Human Resources Division.

6.20

Flexible Working Policy

The Company is committed to providing equality of opportunity in employment and developing working practices and policies that support work-life balance. The Flexible Working Policy gives eligible Associates an opportunity to formally request a change to their working patterns in accordance with the statutory procedures for such requests. The Company will try to accommodate such requests unless there is justifiable reason for refusal, bearing in mind the needs of the business.

This policy does not form part of an Associate’s contract of employment and the Company may amend it at any time.

Eligibility

To be eligible to make a request under the formal procedure, Associates must:

be an Associate;

 have worked for the Company continuously for 26 weeks at the date the request is made; and

 not have made a formal request to work flexibly during the last 12 months (each 12-month period runs from the date when the most recent application was made).

The policy does not apply to agency workers, consultants or self-employed contractors.

Associates will need to submit a written application if they would like their flexible working request to be considered under the formal procedure.
